Terms of Service

The short version. Be decent to other people, don't abuse the service, and don't use PingUp if you're under the minimum age. We'll do our best to keep it running, but we can't promise perfection.
1. Accepting these terms
These terms are an agreement between you and PingUp By creating an account or using the PingUp app or website, you agree to them. If you don't agree, don't use PingUp.
Our Privacy Policy explains how we handle your information and is part of these terms.
2. Who can use PingUp
You must be at least 13 years old to use PingUp. If you're under the age of majority where you live, you need a parent or guardian's permission. You also must not be barred from using the service under applicable law.
3. Your account
- Give accurate information when you sign up, and keep it current.
- You're responsible for keeping your login credentials secure and for activity that happens under your account.
- Tell us promptly at support@sendpings.com if you think someone else has access to your account.
- Don't impersonate someone else or pick a username designed to mislead.
4. Rules of use
PingUp exists to help people stay in touch warmly. Don't use it to:
- Harass, threaten, bully, or stalk anyone.
- Send Pings to people who've asked you to stop, or to get around being blocked.
- Post or send content that's hateful, sexually explicit, violent, or illegal.
- Spam, send bulk unsolicited Pings, or run automated or scripted activity against the service.
- Break into, probe, overload, or interfere with our systems, or try to access data that isn't yours.
- Scrape or harvest information about other users.
- Reverse engineer the app, except where that right can't be restricted by law.
We use automated moderation to screen usernames and custom message content. We may remove content or restrict accounts that break these rules.
5. Your content
You keep ownership of the content you create — your profile picture, custom messages, and anything else you add. You give us a limited licence to store, display, and transmit that content solely so we can operate PingUp for you and deliver your Pings to the people you send them to.
You're responsible for making sure you have the right to share what you upload.
6. Ping points and purchases
PingUp may include points, streaks, unlockable features, subscriptions, or in-app purchases. Points and virtual items have no cash value, can't be exchanged for money, and may be adjusted or discontinued.
Purchases made through the App Store are handled by Apple and are subject to Apple's terms and refund policies. Subscriptions renew automatically unless you cancel through your App Store account settings.
7. Service availability and changes
We're actively building PingUp, so features may change, be added, or be removed. We may modify or discontinue parts of the service, and we'll give reasonable notice of significant changes where we can. We don't guarantee uninterrupted or error-free service.
8. Suspension and termination
You can delete your account at any time from within the app. We may suspend or terminate an account that breaks these terms, creates risk or legal exposure, or has been inactive for an extended period. Where appropriate, we'll let you know why.
9. Disclaimers
PingUp is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee that Pings will always be delivered, or delivered on time — don't rely on PingUp for emergencies or urgent communication.
10. Limitation of liability
To the fullest extent permitted by law, PingUp and its team aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim.
Some jurisdictions don't allow these limitations, so parts of this section may not apply to you.
11. Governing law
These terms are governed by the laws of the United States of America, without regard to conflict-of-law rules. Disputes will be handled in the courts located in your JURISDICTION, unless applicable law gives you the right to bring a claim elsewhere.
